ChessGuides, LLC (“ChessGuides”) values your privacy. Accordingly, our goal is to collect as little information from you as necessary to provide a positive and fulfilling experience on our Site, and we constantly work to ensure that information remains safe and protected. We believe in transparency, so we created the following Privacy Policy to explain what information our Site collects, how this information is stored and used, how this information is protected and, most importantly, your rights in relation to this information.
Please read the following Privacy Policy carefully. If you do not expressly agree to all of the following information handling practices in this Privacy Policy, please do not access our Site or utilize our Services.
Users under 18 years of age must review this Privacy Policy with a parent or legal guardian to ensure the parent or legal guardian acknowledges, understands and agrees to this Privacy Policy.
Please note that this policy is subject to the Terms and Conditions in ChessGuides’ Terms of Service Agreement.
I. DATA AND INFORMATION COLLECTED
Information collected. ChessGuides may, from time to time, collect user data and information to provide tailored Services and improve the user’s ChessGuides experience. For purposes of this Privacy Policy, a user is broadly defined as any visitor to our Site. ChessGuides collects the following information from users:
· IP addresses, browser types and referring sites;
· Personally identifiable information (such as first and last names, phone numbers and email addresses);
· Data regarding your online behavior on our Site;
· Data and information regarding your chess play; and
· Other information regarding your interests and preferences.
How your information is collected. ChessGuides obtains personal information in three primary ways:
· Information that you, the user, provide to us directly (such as through the registration process or through public comments on our Site);
· Information that is recorded automatically when you access our Site (such as through the use of cookies or similar technologies); and
· Information provided by third parties (such as limited financial information when you pay for a subscription through PayPal or Stripe).
Personal information provided by you. ChessGuides only solicits the personally identifiable information necessary to provide the user with high quality, effective Services.
A majority of a user’s personally identifiable information is collected during the initial registration process. This information includes the registrant’s first and last name, the name and age of the student who will be utilizing ChessGuides’ Services (age will be provided in number only, dates of birth will not be requested) and the registrant’s email address to register and manage the account. ChessGuides also obtains limited financial information from the registrant paying for subscription services, including the last four digits, the country of issuance and expiration date of the registrant’s payment card. Please be advised that ChessGuides utilizes third party services, PayPal and Stripe, for subscription payment collection so a registrant’s financial information will also be subject to the privacy policies of these third-party vendors.
ChessGuides may also maintain information obtained through user comments and inquiries posted to the Site or sent directly to ChessGuides, as well as information pertaining to a user’s chess rating or ranking, chess games played, and strategies used when a user plays in ChessGuides’ tournaments and miscellaneous chess play. This information may be used by guides to help users improve and expand their chess skills and knowledge.
Information obtained through accessing our Site. When a user accesses our Site, ChessGuides may automatically collect information, such as IP addresses. This information is typically collected via cookies and similar technologies when a user accesses our Site. For more information on our use of cookies, please review our Cookie Policy in Section IV below.
Information obtained through third parties. Our Site contains links to external websites and uses a number of third-party services to ensure our users have a valuable and fulfilling experience. ChessGuides does not control, endorse, or screen these external websites and third-party services. In some circumstances, your information may also be subject to collection by these third parties. ChessGuides is not responsible for your data and privacy protection if you visit these external websites and/or utilize third-party services through our Site. Visitation of external websites and use of third-party services is at your own risk. The data and information collection practices of these external websites and third-party services is not governed by this Privacy Policy. Accordingly, we ask that you also read and review the privacy policies of all external links posted and third-party service providers, including but not limited to, PayPal, Stripe, chess.com, lichess.org, Skype, YouTube and Squarespace.
Parental rights and consent. In compliance with 15 U.S.C. 6501-6505, the Children’s Online Privacy Protection Act of 1998 (“COPPA”), as well as other applicable legislation, ChessGuides only obtains information about a child under the age of 13 from the child’s parent or legal guardian and with the approval of the child’s parent or legal guardian. ChessGuides strictly limits the information it obtains about children under the age of 13 from parents and legal guardians to that information which is absolutely necessary for creating a ChessGuides account. ChessGuides mandates that the parent or legal guardian of a child under 13 use their own name and email address when registering their child for a ChessGuides’ account. Student name and age (number only, date of birth will not be requested) is the only personally identifiable information ChessGuides will request of a child under 13 years of age with the consent of the child’s parent or legal guardian. Once a child under 13 years of age has been registered for a ChessGuides account by a parent or legal guardian, the parent or legal guardian will be able to sign into the account at any time and will have access to and control over the information provided, and may review, edit, or delete the information provided at any time.
Any data or information collected from and with the consent of the parent or legal guardian of a child under 13 years of age (e.g. student name and age), as well as any information collected automatically through the use of cookies and similar technology (e.g. IP address), will only be subject to internal usage to render ChessGuides’ Services and will not be shared with outside individuals or entities. Additionally, ChessGuides only retains the information collected for as long as necessary to complete the purposes it was collected for, which includes student registration and account maintenance.
Children under 13 years of age cannot, under any circumstances, access our Site or utilize our Services without the consent and approval of a parent or legal guardian. In order to ensure the parent or legal guardian of a child under 13 years of age consents to the child’s access of our Site and use of our Services, ChessGuides requires written parental or guardian consent in the form of an electronic confirmation. This electronic confirmation process is as follows:
For all new registrants who have identified a ChessGuides student as being under 13 years of age during the registration process, ChessGuides will send out an email to the parent or legal guardian email address provided. This email will request confirmation of the parent or legal guardian’s consent and approval of the child’s access to our Site and use of our Services;
The parent or legal guardian must then respond to that email with their consent and approval;
ChessGuides will then send a second confirmation email acknowledging receipt of the parental or guardian consent;
Following this process, the child may then proceed to access our Site and utilize our Services.
If no response is received from a parent or legal guardian confirming consent to the child’s use of our Services, the child will not be allowed to access our Site or utilize our Services. Further, a parent or legal guardian may revoke or rescind consent for a child’s use of our Services at any time. A parent or legal guardian may also revoke or rescind consent for ChessGuides’ collection and use of limited registration information at any time.
Following the initial registration process, children under 13 years of age are strictly prohibited from providing any personal or personally identifiable information to ChessGuides, with or without the consent of a parent or legal guardian. Personal or personally identifiable information can include but is not limited to name, email address, home address, telephone number, or any other forms of personally identifiable information. ChessGuides does not knowingly collect personal or personally identifiable information from children under 13 years of age either directly or indirectly, and mandates adherence to the rules described in this Privacy Policy.
II. WHY DATA IS COLLECTED AND HOW IT IS USED
Reasons for data collection. ChessGuides collects your data and information to improve your experience on our Site. The data and information you provide helps us better understand your needs and what you would like to get out of our Site, improve our services and products, and ensure we’re providing top-notch chess guidance to our users. ChessGuides collects your information and data for the following reasons:
· Provision of services. This includes registering and managing a subscription account with ChessGuides, providing and improving our Services, processing payment and responding to comments and inquiries, as applicable.
· Communications. This includes sending confirmation correspondences, invoices, responses to comments and inquiries and other notifications regarding classes, tournaments and other opportunities ChessGuides may provide for account holders.
· Provision of chess play activities. This includes administering, monitoring and overseeing chess tournaments and games among ChessGuides account holders and users.
· Provision of chess classes. This includes administering, monitoring and overseeing class sessions taken by account holders and users.
· Improving our Services. ChessGuides may also use information obtained from our users to learn about how our Services are used and how they can be improved. Improving our Services may include developing new products and services, adding or amending classes and chess activities, altering the way classes and chess activities are run and managing our methods and modes of communication.
· Security. Your data and information may be used when necessary to protect user security or the security of other persons in compliance with applicable laws.
· Enforcement. Your data and information may be used to enforce the Terms and Conditions provided in our Terms of Service Agreement, including but not limited to, our honesty and candor policy and online conduct policy.
· Protection. Your data and information may be used to protect ours and others’ interests, rights and property from abuses in compliance with applicable laws.
How your data and information is used. ChessGuides’ policy with regards to how the data and information you provide to us is used is simple: we will only use your information to render enjoyable and effective chess learning Services. ChessGuides will not sell, rent, disclose, exploit or share your data and information with third parties. However, our Site does contain links to external websites and uses a number of third-party services to ensure our users have a valuable and fulfilling experience, including but not limited to, chess.com, lichess.org, Skype and YouTube. These third parties may have their own information and data collecting policies and procedures, so we encourage users to familiarize themselves with the privacy policies of these companies prior to utilizing our Services.
ChessGuides may disclose your information in limited circumstances, such as (a) in response to a subpoena, court order or legal process, as permitted and required by law; (b) to protect user security or the security of other persons in compliance with applicable laws; (c) in connection with a sale, joint venture or other transfer of some or all of ChessGuides assets; or (d) in order to enforce our Terms of Service. Otherwise, ChessGuides will not sell, rent, disclose, exploit or share your data or information to third parties without the user’s consent and prior approval.
Data retention. We retain the data and information we receive as described in this Privacy Policy for as long as you use our Services or as necessary to fulfill the purposes for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements and comply with applicable laws.
Parental control of minor child data usage. As mentioned above, ChessGuides only collects limited information from parents or legal guardians of children under 13 years of age during the account registration process for internal use only. This information will not be given to third parties or outside individuals or entities by ChessGuides.
Public postings. Users must be aware that any information posted to public forums, posted publicly during class sessions or tournaments or even verbally volunteered during class sessions or tournaments may be collected and used by others. ChessGuides cannot guarantee protection from such collection and usage. Any information a user provides publicly in the course of accessing our Site or utilizing our Services, either verbally or in writing, is done so at the user’s own risk and peril.
III. SAFETY AND SECURITY OF YOUR INFORMATION
ChessGuides follows general industry standards to protect the information submitted to us and takes precautions to ensure that your information remains secure and in accordance with this Privacy Policy. However, transmission of information over the internet or any other method of electronic storage cannot be guaranteed to be 100% secure. Thus, ChessGuides cannot ensure and warrant the security of any information you provide to us and we do not accept liability for unauthorized information access, disclosure, destruction or alteration.
Additionally, during classes and tournaments, guides and other users will only be able to see the username you have chosen and will not have access to your personal information. If you believe a guide or other user has improperly attempted to solicit personal information from you or that your personal information has otherwise been compromised, please contact us by emailing contact@www.chessguides.org.
By using our Services, you agree that we may contact you electronically via email if we learn of any security or privacy breach or other issue relating to your access to our Site and use of our Services.
IV. COOKIE POLICY
ChessGuides may use automated cookies to remember user preferences and account information, as well as automatically record certain information from your device. Specifically, ChessGuides uses functional and required cookies, as well as analytics and performance cookies to collect information, such as IP addresses, browser type, system type, the web pages you visit just before or just after accessing our Site, the date and time you access our Site, device type, and other similar data. This information is gathered from all users. However, a user can always change their personal cookie settings on the device from which they access our Site.
V. YOUR CHOICES REGARDING DATA COLLECTION
User control over personal information. All ChessGuides account holders have the ability to review, edit, update, amend or delete your personal information through your account. Users may also decline to share personal information with ChessGuides or withdraw consent to continued information collection and storage at any time in accordance with applicable laws. Such declination to share personal information or withdrawal of consent to information collection and storage may result in the user’s inability to begin or continue using our Services which will be explained to the user.
If a user has any objection to the collection of their personal information or wishes to review, edit, update, amend or delete any of their personal information already provided, please contact us by emailing contact@www.chessguides.org.
Account deletion. If you have created an account with ChessGuides, you may delete your ChessGuides account at any time and ChessGuides may also delete or suspend your account at our sole discretion, with or without prior notice. Even after you delete your account, your personal information may be stored for legal purposes only for as long as necessary to complete those purposes.
Electronic correspondence. By using ChessGuides’ services, you acknowledge and agree that we may send emails regarding administrative information about your account, such as impending expiration of your account, changes to our Terms and Conditions or other administrative information. Once you have signed up for an account, you cannot unsubscribe from administrative emails. However, you may, at any time, choose to unsubscribe from any promotional or marketing emails. VI. INTERNATIONAL USERS
ChessGuides is a United States company. If a user is accessing our Site from the European Union or any other region with laws governing data collection and use that may differ from United States law, please note that you are transferring your personal data outside of those jurisdictions to the United States. The United States does not have the same data protection laws as the European Union and other regions. By providing personal information under this policy, you consent and agree to the use of your personal information in accordance with this policy.
VII. MODIFICATIONS TO THIS PRIVACY POLICY
We reserve the right, at our sole discretion, to modify any portion of this Privacy Policy at any time. Changes in this Privacy Policy will be effective when posted. The modifications will be posted in this policy and in any other place we deem appropriate so that you are aware of changes in the information we collect, how it is used and how it is protected. Your continued use of our Site and/or the products or services offered on or through our Site after any changes to this Privacy Policy are posted will be considered acceptance of those changes.
